The public sector workers in the state are overseen by the West Virginia Division of Labor. Also specifically exempt from State OSHA regulations are staff members of the West Virginia Legislature, the Department of Health, and the Department of Prisons.
Because Federal OSHA requires training on specific health and safety topics and the majority of employers in West Virginia demand OSHA training to ensure workers have an adequate awareness of Occupational Safety and Health, OSHA recommends its OSHA 10 Hour courses for entry-level workers and its OSHA 30 Hour courses for employees with supervisory roles.
Additionally, employees working on construction projects costing more than $500,000 must obtain their OSHA 10 Hour Construction Certification within 21 days of their appointment, as per WV Law 21-3-22. These initiatives involve construction, reconstruction.
